These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and MyCoop ("MyCoop," "we," "us," or "our"), operated by Daniel Swick / MyCoop ("Company"), governing your use of the MyCoop platform, website, and related services (collectively, the "Service").
These Terms apply to two types of users:
For Family Users specifically: You are creating an account to participate in a homeschool co-op that uses MyCoop as its management platform. MyCoop provides the technology; your co-op provides the programs. Your co-op may have its own membership agreement, code of conduct, and participation waivers — those are separate agreements between you and your co-op. By accepting these Terms, you agree to MyCoop's role as the technology platform enabling those interactions.
By checking the acceptance boxes and typing your name on the acceptance screen, you confirm that you are at least 18 years of age, or that you are the parent or legal guardian consenting to and accepting these Terms on behalf of a participant under 18 in your care; that you have the legal authority to enter into this agreement (including on behalf of minor children in your care); and that you accept these Terms in full.
MyCoop is a Software-as-a-Service ("SaaS") platform for homeschool co-op management, providing tools for: family and student roster management; class enrollment and waitlists; attendance tracking; electronic waiver signatures; email and SMS communications; volunteer hour tracking; payment processing; photo galleries; educational resources; and related administrative functions.
MyCoop acts as a data processor on behalf of Organizations. Organizations retain ownership of and responsibility for all data they input into the Service.
Accounts are created and managed through Clerk, Inc., our authentication provider. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately at [email protected] of any unauthorized use of your account.
Organizations are responsible for managing access permissions for their members, teachers, and staff. MyCoop is not responsible for unauthorized access resulting from an Organization's failure to properly manage account permissions.
MomBlog account eligibility. MomBlog accounts are for adults. You must be 18 years of age or older to create a MomBlog account, except that an account for a participant under 18 may be created and used with the prior written consent of that participant's parent or legal guardian. A parent or guardian who consents remains responsible for activity on that account, and may review the information associated with it, withdraw consent, or ask us to close the account at any time. By creating a MomBlog account you represent that you meet one of these conditions. If we learn that a MomBlog account is held by someone under 18 without a parent or guardian's consent, we may suspend or close it.
By creating a MyCoop account, you agree to receive communications from MyCoop related to your use of the Service. These communications fall into two categories:
Service Communications (required, cannot be opted out of while account is active): These include account notices, billing and payment alerts, subscription changes, security notifications, data breach notices, legal and policy updates (including updates to these Terms), onboarding guidance, and other communications necessary to provide and support the Service. Service communications may be sent via email, in-app notification, or phone.
Consultation and Onboarding Outreach: MyCoop may contact Organization administrators — including by email, phone, or video call — to introduce the platform, conduct onboarding consultations, gather feedback, discuss your co-op's needs, and offer personalized setup assistance. This outreach is part of the Service and reflects MyCoop's commitment to hands-on customer success, particularly for new and early-stage Organizations. You may opt out of future consultation outreach at any time by replying to any such communication or emailing [email protected].
Product and Marketing Communications (optional, opt-out available): From time to time, MyCoop may send emails about new features, product updates, best practices, co-op management tips, and promotional offers. Every marketing email will include an unsubscribe link in compliance with the CAN-SPAM Act. Opting out of marketing emails does not affect your receipt of required service communications.
SMS Communications: MyCoop will only send SMS messages to Organization administrators for service-critical alerts (e.g., payment failures, security incidents) if you have provided a phone number and opted in. Reply STOP to any SMS to opt out.
You agree not to use the Service to:
MyCoop reserves the right to suspend or terminate accounts that violate this Acceptable Use Policy without prior notice.
MyCoop does not directly solicit or collect personal information from children under 13. Organizations (co-op administrators) are responsible for collecting student information in compliance with COPPA, applicable state student privacy laws, and any other applicable regulation.
MyCoop acts as a data processor for student records entered by Organizations. Organizations represent and warrant that they have obtained all required parental or guardian consents before inputting any minor's information into the Service.
Parents and guardians retain rights under applicable law to access, correct, or request deletion of their child's personal information. These requests should be directed to the Organization administrator. MyCoop will cooperate with Organizations in honoring verified deletion requests within 30 days.
MomBlog account eligibility (age 18+, with a parent/guardian consent path for younger participants) is addressed in Section 3, User Accounts — that rule reaches everyone under 18, not only children under 13, so it lives with the general account-eligibility rules rather than in this COPPA-specific section.
Organization subscriptions are billed through Whop, Inc., our vendor-of-record for SaaS subscription billing. By subscribing, you agree to Whop's Terms of Service in addition to these Terms.
Family payment processing (class fees, event fees) is handled through Stripe Connect. When a Family pays a class or event fee, MyCoop receives that payment solely for the purpose of transmitting it to the Organization providing the class; MyCoop does not hold the funds for its own benefit, pays no interest on amounts in transit, and no escrow, trust, or fiduciary relationship is created between MyCoop and any Family or Organization. Funds are transferred to the Organization's connected account automatically, generally within Stripe's standard payout timeline. MyCoop does not store, retain, or have access to complete payment card numbers — only transaction metadata (date, amount, last 4 digits) is retained for record-keeping.
Merchant of record. The Organization is the seller and provider of the class or event a Family is paying for. MyCoop is the merchant of record on the card transaction itself, meaning the charge is processed under MyCoop's Stripe account. As a result, the charge will appear on a Family's card or bank statement under MyCoop's name, not the Organization's.
Chargebacks and refunds. Because MyCoop is the merchant of record, a card network dispute (chargeback) on a Family payment is initially assessed against MyCoop's account. MyCoop may reverse the corresponding transfer to the Organization, debit the Organization's connected account, or otherwise recover the disputed amount from the Organization. For refunds, the Organization decides eligibility and MyCoop executes the refund and recoups the amount from the Organization's connected account.
Payment agency (Organizations). By accepting payment processing through MyCoop, an Organization appoints MyCoop as its limited agent for the sole purpose of receiving class and event fee payments from Families on the Organization's behalf. A Family's payment obligation to the Organization is discharged at the moment MyCoop receives it, regardless of when or whether MyCoop completes the transfer to the Organization's connected account.
Subscription fees are non-refundable except as required by applicable law or as explicitly offered by MyCoop in writing. Organizations may cancel their subscription at any time; cancellation takes effect at the end of the current billing period.
MyCoop reserves the right to modify subscription pricing with 30 days' written notice to Organization administrators. Continued use after the notice period constitutes acceptance of the new pricing.
Organizations control the retention period for their data. Organizations may request deletion of any family, student, or enrollment record through the admin dashboard or by contacting [email protected].
MyCoop will delete requested data from live systems within 30 business days. Deleted data may persist in encrypted backups for up to 90 days before being purged. Organizations are responsible for documenting deletion requests for their own compliance purposes.
Upon termination of an Organization's subscription, MyCoop will retain data for 90 days to allow for data export. After 90 days, all Organization data will be permanently deleted.
Trials and lapsed access. Where an Organization's trial ends without conversion to a paid subscription, or an Organization's access to the Service otherwise ends without a termination under Section 7, the retention period described above begins on the date access ends. MyCoop will retain that Organization's data for at least 90 days from that date so that the Organization can obtain a copy of it, and will provide a copy on request to the Organization's administrator, using the contact address given in this Section, during that period. After that period MyCoop may delete the Organization's data, and will delete it on the Organization's request under the process described in this Section. MyCoop will not delete an Organization's data during any period in which that Organization is unable to access the Service through no fault of its own.
Legal acceptance records (proof of acceptance of this TOS and the Privacy Policy) are retained for 6 years after the later of acceptance or account closure, regardless of account termination. Payment records are retained for 7 years as required by applicable tax and financial record-keeping law. See the Privacy Policy's Data Retention section for full detail, including how long IP addresses are kept.
The MyCoop platform, including its code, design, trademarks, and content created by MyCoop, is owned by MyCoop and protected by applicable intellectual property laws.
Organizations and Users retain ownership of all content, data, and information they upload to the Service ("User Content"). By uploading User Content, you grant MyCoop a limited, non-exclusive, royalty-free license to store, process, and display User Content solely to provide the Service. MyCoop will not use User Content for any other purpose, including training machine learning models.
MyCoop relies on third-party service providers to operate the Service, in the following categories: cloud database and application hosting; file and object storage; authentication and user account management; payment processing; transactional email; and SMS and voice messaging. These providers are located in the United States and are engaged under data processing agreements permitting them to process data only to provide services to MyCoop. The providers currently used are identified in MyCoop's Privacy Policy.
Payments to Organizations for class and event fees are processed through Stripe Connect; Organizations receiving those payments are Stripe connected accounts and are subject to Stripe's Merchant and Connected Account Terms.
MyCoop is not responsible for the practices, availability, or content of third-party services.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED SERVICE. MYCOOP DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR THAT DEFECTS WILL BE CORRECTED.
MyCoop implements industry-standard security measures including SSL/TLS encryption in transit and encryption at rest for sensitive data. However, no method of electronic transmission or storage is 100% secure. In the event of a data breach affecting student or family data, MyCoop will notify affected Organizations within 72 hours of discovery. Organizations are responsible for complying with applicable state breach notification laws to parents and families.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MYCOOP, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, REVENUE, PROFITS, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
MYCOOP'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL SUBSCRIPTION FEES PAID BY THE ORGANIZATION TO MYCOOP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OF LIABILITY FOR CERTAIN TYPES OF DAMAGES (SUCH AS PERSONAL INJURY). IN SUCH JURISDICTIONS, THE ABOVE LIMITATIONS APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.
Organizations agree to indemnify, defend, and hold harmless MyCoop and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from: (a) the Organization's use of the Service; (b) User Content uploaded by the Organization; (c) the Organization's violation of these Terms; or (d) the Organization's failure to obtain required parental consents for children's data.
14.1 What Mom Shop is. Mom Shop is a noticeboard within Mom Blog. Members post items they wish to sell, and other members contact the seller directly to arrange the sale. MyCoop is not a party to any Mom Shop transaction. We do not sell, buy, hold, inspect, appraise, insure, ship, or deliver any item, and no payment for any item passes through the Service. Every sale is a private transaction between two members, on whatever terms they agree between themselves.
14.2 Who may use Mom Shop. Mom Shop involves arranging in-person exchanges with other members, so it has its own, stricter age rule: you must be at least 18 years old to buy or sell through Mom Shop, with no guardian-consent exception (unlike Section 3's general MomBlog account rule). You must also be the parent or legal guardian of any child associated with your account, and you may not allow a minor — including a minor who holds their own MomBlog account under Section 3 — to use your account, post a listing, contact a seller, or negotiate on your behalf. You are responsible for everything done through your account.
14.3 We do not screen, endorse, or guarantee anything. We do not verify members, review listings before they appear, inspect items, confirm ownership or title, or run background checks of any kind. A listing is not a recommendation. We make no representation or warranty of any kind about any item, listing, price, or member, and we disclaim all implied warranties, including merchantability and fitness for a particular purpose, as to any item listed by a member.
14.4 We may remove listings. We do not have to look for them. We may remove or refuse any listing, and suspend or terminate any member's access to Mom Shop, at any time, with or without notice, for any reason. We have no obligation to monitor Mom Shop. Acting in one instance does not oblige us to act in any other.
14.5 Items you may not list. You may not list on Mom Shop, or sell through a contact made on Mom Shop:
It is your responsibility to know whether something you list has been recalled. Before listing any children's product, check the CPSC recall list at cpsc.gov/Recalls.
14.6 Meeting in person. Most Mom Shop sales end with two people meeting to hand over an item. That is your decision and your risk. We suggest — but do not require, monitor, or enforce — that you meet in a public place in daylight, bring another adult, tell someone where you are going, inspect the item before you pay, and not invite someone you do not know to your home. If children are present at an exchange, they remain your responsibility at all times. We do not supervise or attend any meeting arranged through Mom Shop, and nothing in this section creates any duty on our part to protect you.
14.7 Taxes and your own compliance. You are solely responsible for working out whether a sale creates a tax, licensing, or registration obligation for you, and for meeting it. We do not collect or remit tax on member sales, do not issue tax forms for them, and do not give tax or legal advice. If you are selling as a business rather than passing on your own household items, additional tax and consumer-protection rules may apply to you.
14.8 Disputes between members. Any dispute about an item, a payment, a no-show, a description, or anything else arising from a Mom Shop transaction is between the members involved. We have no obligation to mediate, investigate, refund, or reimburse. To the fullest extent permitted by law, you release MyCoop, its affiliates, and their officers, employees, and agents from all claims, demands, damages, and losses of every kind arising out of or connected with any Mom Shop listing, communication, transaction, or in-person meeting.
If California law applies to you, you waive California Civil Code Section 1542, which states: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."
14.9 Your listings. You confirm that you own each item you list or have the right to sell it, that the photographs are yours, and that your listing is accurate and not misleading. Intellectual Property (§9) applies to listing text and photographs.
14.10 Reporting a problem. If you see a listing that is unsafe, prohibited, or fraudulent, use the report control on the listing or contact us at [email protected]. We review reports and may remove content, but we do not promise any particular outcome or timeframe.
14.11 The rest of these Terms still apply. Limitation of Liability (§12) and Indemnification (§13) apply to Mom Shop, including to the conduct of other members and to any in-person meeting arranged through it.
These Terms are governed by the laws of the State of Ohio, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules, with the arbitration conducted in Newark, Ohio.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm. Class action waiver: all claims must be brought in the parties' individual capacity, not as a plaintiff or class member in any purported class or representative proceeding.
MyCoop may update these Terms from time to time. When we make material changes, we will update the version date at the top of this page and require users to re-accept via the acceptance screen on their next login. Continued use of the Service after re-acceptance constitutes agreement to the updated Terms.
For non-material changes (typographical corrections, clarifications), we may update these Terms without requiring re-acceptance.
